Chapter I General Provisions

Article 1 in order to strengthen the party's unified leadership over discipline inspection and state supervision, strengthen the party's discipline construction, promote the comprehensive and strict administration of the party, and standardize the supervision and enforcement of discipline inspection and supervision organs, these rules are formulated in accordance with the Constitution of the Communist Party of China and relevant laws, combined with the reform of the discipline inspection and supervision system and the practice of supervision and enforcement of discipline.

Article 2 Adhere to the guidance of Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the Important Thought of the "Three Represents", the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, and fully implement the requirements for the joint office of the Disciplinary Inspection Committee and the Supervisory Committee. Strictly supervise and enforce discipline in accordance with regulations and laws, insist that iron must be hard, put power in the system cage, and build a loyal, clean and responsible discipline inspection and supervision cadres.

Article 3 The following principles shall be observed in the supervision and enforcement of discipline:

(I) uphold and strengthen the party's overall leadership, firmly establish political awareness, overall awareness, core awareness, and alignment awareness, strengthen self-confidence in the path of socialism with Chinese characteristics, theoretical self-confidence, institutional self-confidence, and cultural self-confidence, and resolutely maintain the core of the Party Central Committee of General Secretary Xi Jinping, The core position of the whole party resolutely maintains the authority of the Party Central Committee and centralized and unified leadership, strictly observes political discipline and political rules, and political rules, and reflects the political nature of supervision, construct the supervision system of the party's unified command, comprehensive coverage, authority and high efficiency;

(II) adhere to the dual leadership system of discipline inspection work, supervise discipline enforcement work with the leadership of the discipline inspection commission at a higher level, and report to the discipline inspection commission at a higher level while reporting to the party committee at the same level;

(III) adhere to seeking truth from facts, take facts as the basis, take the party constitution, party rules, party discipline, and national laws and regulations as the criterion, strengthen supervision, strictly enforce discipline, grasp policies, combine leniency with leniency, and leniency to voluntarily surrender and proactively account for problems, and refuse to account, Strictly deal with deceiving organizations;

Article 4 Persist in punishing the past, treating the sick and saving people, putting discipline in the forefront, accurately and effectively using the "four forms" of supervision and discipline, integrating ideological and political work throughout the entire process of supervision and discipline, combining strict management with love, emphasizing both encouragement and restraint, and focusing on education Transformation, urge party members to consciously prevent and correct violations of discipline, punish a very small number, educate the majority, and achieve the unity of political, discipline and social effects.

Chapter II Leadership System

Article 5 The Central Commission for Discipline Inspection shall work under the leadership of the Party Central Committee. Local commissions for discipline inspection at all levels and primary-level commissions for discipline inspection work under the dual leadership of the Party committee at the same level and the commissions for discipline inspection at the next higher level.

The party committee shall regularly listen to and review the work reports of the disciplinary inspection committee and the supervisory committee at the same level, and strengthen the leadership, management and supervision of the work of the disciplinary committee.

Article 6 the party's discipline inspection organs and state supervisory organs are the special organs responsible for the self-supervision of the party and the state. The Central Commission for Discipline Inspection and local discipline inspection commissions at all levels implement the decision-making and deployment of the Party Central Committee on state supervision work, deliberate and decide on important matters in the performance of duties according to law, integrate discipline enforcement and law enforcement, and realize the organic unity of inner-party supervision and state supervision.

Article 7 A hierarchical responsibility system shall be adopted for the supervision and discipline enforcement work:

The (I) Central Commission for Discipline Inspection and the State Supervision Commission is responsible for supervising, inspecting and investigating members of the Central Committee, alternate members of the Central Committee, members of the Central Commission for Discipline Inspection, leading cadres under central management, working departments of the Party Central Committee, Party groups (Party committees) approved by the Party Central Committee, Party committees of all provinces, autonomous regions, and municipalities directly under the central government, Discipline Inspection Commission and other party organizations suspected violations of discipline or duty crimes.

(II) local discipline inspection commissions at all levels are responsible for supervising, inspecting, examining and investigating members and alternate members of party committees at the same level, members of discipline inspection commissions at the same level, party members, cadres, and supervision objects managed by party committees at the same level, party groups (party committees) approved by party committees at the same level, party committees at the next level, discipline inspection commissions, and other party organizations suspected of violating discipline or job-related violations or job-related crimes.

(III) grass-roots discipline inspection commissions are responsible for supervising, inspecting and examining suspected violations of discipline by party members managed by party committees at the same level and party organizations at all levels subordinate to party committees at the same level; party grass-roots committees that have not set up discipline inspection committees shall be responsible for supervising discipline enforcement.

Local discipline inspection commissions at all levels shall, in accordance with regulations, strengthen supervision over the performance of duties and the exercise of power by party committees at the same level.

Article 8: Party members, cadres, and supervision objects whose party's organizational relationship is in the local area and whose cadre management authority is in the competent department are suspected of violating discipline and law, supervision and discipline shall be carried out in accordance with the principle of who is in charge and who is responsible. The competent disciplinary inspection and supervision agency conducts review and investigation. If the competent authority deems it necessary, it may jointly review and investigate with the local disciplinary inspection and supervision agency. If the local discipline inspection and supervision organs receive clues to the problem, they may, after coordination with the competent department, conduct an examination and investigation, or form a joint examination and investigation team with the competent department, and inform the other party of the examination and investigation in a timely manner.

Article 9: Higher-level discipline inspection and supervision agencies have the right to designate lower-level discipline inspection and supervision agencies to conduct investigations on suspected violations of discipline, duty violations, and duty crimes by party organizations, party members, cadres, and supervision objects under the jurisdiction of other lower-level discipline inspection and supervision agencies. Review and investigate. A higher-level discipline inspection and supervision organ may designate a lower-level discipline inspection and supervision organ for examination and investigation of a matter under its direct jurisdiction.

If there is a dispute between discipline inspection and supervision organs over matters under their jurisdiction, it shall be determined by their common discipline inspection and supervision organs at a higher level; if they think that the matters under their jurisdiction are major and complex and need to be under the jurisdiction of the discipline inspection and supervision organs at a higher level, they may report to the discipline inspection and supervision organs at a higher level for jurisdiction.

Article 10 Discipline inspection and supervision organs shall strictly implement the system of requesting instructions and reporting. The Central Commission for Discipline Inspection regularly reports its work to the Party Central Committee, studies major issues involving the overall situation, encounters important issues, and makes decisions on filing, review and investigation, and gives party discipline and government sanctions. It should promptly request instructions and reports to the Party Central Committee, and report both the results and the process. The implementation of important decisions of the Party Central Committee should be reported on a special topic.

Local discipline inspection and supervision organs at all levels shall ask for instructions from the party committee at the same level and report to the supervision committee of the discipline inspection commission at the higher level for important matters such as making decisions on filing a case for examination and investigation and giving party discipline and government sanctions, and then formally issue a document for instructions after forming a clear opinion. Important matters should be reported in a timely manner.

Discipline inspection and supervision organs shall adhere to democratic centralism, and report to the relevant responsible persons and main responsible persons of discipline inspection and supervision organs for examination and approval of important issues in clue handling, conversation and letter inquiry, preliminary verification, case filing, examination and investigation, case trial, and disposal and implementation after collective study.

Article 11 The discipline inspection and supervision organs shall establish a working mechanism for mutual coordination and mutual restriction of supervision and inspection, examination and investigation, case supervision and management, and case trial. The supervision and inspection departments are mainly responsible for contacting the daily supervision and inspection of regions, departments and units and handling clues of suspected general violations of discipline, and the examination and investigation departments are mainly responsible for preliminary verification and filing investigation of clues of suspected serious violations of discipline or job violations and job-related crimes. The case supervision and management department is responsible for supervising and managing the whole process of supervision, inspection, examination and investigation, the case trial department is responsible for reviewing and checking cases that require party discipline and administrative sanctions.

If the discipline inspection and supervision organs need assistance in their work, the relevant organizations, organs, units and individuals shall provide assistance in accordance with regulations, disciplines and laws.

Article 12 the case supervision and management department of the discipline inspection and supervision organ shall be responsible for the supervision and management of the whole process of supervision and discipline enforcement, and do a good job in clue management, organization and coordination, supervision and inspection, supervision and handling, statistical analysis, etc. The supervision department of party style and government style should strengthen the comprehensive coordination of the construction of party style and government style, and do a good job in supervision and inspection, notification and exposure, and comprehensive analysis.

Chapter III Supervision and Inspection

Article 13: The party committee (party group) performs the main responsibility in the supervision of the party, and the discipline inspection and supervision organs perform the supervision responsibility. Article 14 The Commission for Discipline Inspection and Supervision (Discipline Inspection and Supervision Team, Discipline Inspection and Supervision Working Committee) reports or convenes regular special meetings with the party committee (party group) to listen to special reports on strengthening internal party supervision, and comprehensively analyze the political ecology of the contacted regions, departments, and units Situation, put forward opinions and work measures for strengthening and improvement, and do a good job in organizing implementation and supervision and inspection.

Article 15 the discipline inspection and supervision organs shall, in combination with the responsibilities of the supervised objects, strengthen the daily supervision over the exercise of power, understand the thoughts, work style and living conditions of the supervised objects through various ways, and find out the problems of signs, tendencies or minor violations of discipline, they shall timely interview and remind, criticize and educate, order inspection and exhortation talk, Improve the pertinence and effectiveness of supervision.

Article 16 Discipline inspection and supervision organs shall unblock reporting channels such as letters, visits, calls, and the Internet, build a reporting platform covering the discipline inspection and supervision system, accept reports and accusations in a timely manner, and give full play to the supervisory role of party members and the masses.

Article 17 The discipline inspection and supervision organs shall establish and improve the integrity files of party members and leading cadres. The main contents include:

(I) appointments and dismissals, personnel files, and handling of personal matters due to non-truthful reporting;

(II) the clues and disposition of problems handed over by inspection tours, letters and visits, case supervision and management, and other aspects;

(III) the relevant materials resulting from the conduct of interviews and letters, preliminary verification, examination and investigation, and other work;

Reply materials for (IV) party conduct and clean government opinions;

(V) other materials that reflect the integrity of the situation.

Integrity archives should be updated dynamically.

Article 18: Discipline inspection and supervision agencies shall do a good job in responding to opinions on the selection and appointment of cadres, party style and clean government, carefully check the clues that reflect problems, comprehensively use other supervision results such as inspections, and strictly control politics, conduct, style, and integrity.

Article 19 the discipline inspection and supervision organs shall, with regard to the outstanding problems found in the supervision, put forward suggestions for discipline inspection or supervision to the relevant party organizations or units, and supervise and supervise the work by supervising and holding special democratic life meetings and organizing special inspections, so as to promote rectification and reform.

Chapter IV Clue Disposal

Article 20 Discipline inspection and supervision organs shall strengthen the centralized management, classified disposal and regular cleaning of problem clues. The letter and visit reporting department centrally accepts the party organizations, party members, cadres, and supervisory objects under the management of the party committee at the same level for suspected violations of discipline, duty violations, and duty crimes, and uniformly receives relevant letters and visits from relevant discipline inspection and supervision agencies, stationed or dispatched agencies, and other units. Reports are transferred to the relevant departments of the agency to analyze the situation of letters and visits, and promptly reflect the most direct, and most realistic interests of the people.

Inspection and inspection agencies, auditing agencies, administrative law enforcement agencies, judicial agencies and other units shall promptly transfer clues to suspected violations of discipline, duty violations, or duty crimes to the case supervision and management department of the discipline inspection and supervision agency for unified handling.

If the relevant problem clues found by the supervision and inspection department, the examination and investigation department and the cadre supervision department fall within the scope of acceptance of the department, they shall be sent to the case supervision and management department for the record; if they do not fall within the scope of acceptance of the department, they shall be transferred to the case supervision and management department after examination and approval, and shall be transferred to the relevant supervision and discipline enforcement department for handling according to the procedures.

Article 21 The discipline inspection and supervision agency shall combine the overall situation of the regions, departments, and units involved in the clues of the problem, make a comprehensive analysis, and follow the interview letter, preliminary verification, temporary storage for investigation, and settlement 4Disposal in a class manner.

The disposal of clues shall not be delayed or overstocked, and the disposal opinion shall be 1 from the date of receipt of the problem clue.Propose within months, and develop a disposal plan, to fulfill the approval procedures.

Article 22 The discipline inspection and supervision agency shall promptly report to the higher-level discipline inspection and supervision agency on the clues and clues that reflect the problems and clues of the members and alternate members of the party committee at the same level, the Standing Committee of the Discipline Inspection Commission, the members of the Supervisory Committee, and the main persons in charge of the regions, departments, and units under their jurisdiction. report.

Article 23 the case supervision and management department shall carry out centralized management, dynamic update, regular summary and check of the problem clues, put forward opinions of different offices, report to the main person in charge of the discipline inspection and supervision organ for approval, and transfer them to the undertaking department according to the procedures. The undertaking department shall designate a person to be responsible for the management of the problem clues, register the number one by one, and establish a management account. Each link of clue management and disposal shall be signed by the handling personnel and registered for future reference.

Article 24 the discipline inspection and supervision organs shall, in accordance with the needs of their work, hold regular special meetings, listen to reports on the comprehensive situation of problem clues, conduct analysis, research and judgment, conduct in-depth research on important reporting matters and areas that reflect the concentration of problems, and put forward requirements for disposal, so as to ensure that everything has its place.

Article 25 The undertaking department shall do a good job in the handling and filing of clues, and the filing materials shall be complete and complete, indicating the instructions and disposal process of the leaders. The case supervision and management department regularly summarizes and checks the clues and handling of the problems, reports to the main person in charge of the discipline inspection and supervision organ, and informs the relevant departments.

Chapter V Conversation Letters

Article 26 Party committees (leading party groups) and discipline inspection and supervision organs at all levels shall promote the strengthening and standardization of inner-party political life, often take up the weapons of criticism and self-criticism, and promptly carry out talks, reminders, interviews and letters of inquiry, so as to encourage party members, cadres, and objects of supervision to enhance the party's concept and sense of discipline.

Article 27 when dealing with the clues of problems by means of conversation and correspondence, the discipline inspection and supervision organs shall draft a conversation letter for approval, draw up a conversation plan and relevant work plans, and submit them for approval in accordance with the procedures. If it is necessary to consult the principal responsible person of the party committee (leading party group) at the next level, it shall be reported to the principal responsible person of the discipline inspection and supervision organ for approval and, if necessary, report to the principal responsible person of the party committee at the same level.

Article 28 The conversation shall be conducted by the relevant person in charge of the discipline inspection and supervision agency or the person in charge of the undertaking department, and may be accompanied by the relevant person in charge of the party committee (party group) and the discipline inspection and supervision committee (discipline inspection and supervision group, discipline inspection and supervision work committee) where the interviewee is located; After approval, it can also be entrusted to the main person in charge of the party committee (party group) where the interviewee is.

The conversation should be conducted in a place with security conditions. If the conversation is conducted by the discipline inspection and supervision organ, a transcript of the conversation shall be made, and after the conversation, the person to be talked may, depending on the situation, write a written explanation.

Article 29 The discipline inspection and supervision agency shall send a letter to the person being reflected in the name of the general office (office), and copy it to the party committee (party group) where it is located and the main person in charge of the discipline inspection and supervision team. The person to whom the letter is addressed shall, after receipt of the letter, 15The explanatory materials shall be written within 3 working days, and the main person in charge of the Party committee (Party group) shall send a letter to reply after signing the opinions.

If the person being inquired by the letter is the main person in charge of the party committee (party group), or if the explanation made by the person being inquired involves the main person in charge of the party committee (party group), a letter shall be sent directly to the discipline inspection and supervision organ.

Article 30 The undertaking department shall, at the end of the conversation or after receiving the reply to the letter, 1Write a situation report and disposal opinions within months and submit them for approval according to procedures. According to different circumstances to make corresponding treatment:

If the (I) report is not true, or there is no evidence to prove that there is a problem, it shall be accepted and settled, and a letter shall be sent to the person being inquired.

If the (II) problem is minor and does not need to be investigated for disciplinary responsibility, it shall be dealt with by means of conversation reminder, criticism and education, order inspection, exhortation conversation, etc.

(III) the reflection problem is relatively specific, but the reflected person denies it and the reason for the denial is not sufficient and specific, or if it shows that there is an obvious problem, it shall generally talk again or inquire by letter; if it is found that the reflected person is suspected of violating discipline or duty violation or duty crime and needs to be investigated for disciplinary and legal responsibility, it shall put forward suggestions for preliminary verification.

(IV), those who falsely accuse or frame up will be investigated and dealt with in accordance with regulations, discipline and law.

If necessary, spot checks can be made to verify the explanations of the person's conversation letter.

The interview and inquiry materials shall be stored in the archives of clean government.

Article 31 Party members and cadres who have been inquired by conversation and correspondence shall explain the problems of this year's or last year's conversation and correspondence at the democratic life meeting and the organizational life meeting, and clarify the situation of the organization's acceptance and settlement; if there is a problem of violation of discipline, self-criticism shall be carried out and a review shall be made.

Chapter VI Preliminary Verification

Article 32 The party committee (party group) and the Commission for Discipline Inspection and Supervision (discipline inspection and supervision team) shall carry out preliminary verification work on clues of suspected violations of discipline, duty violations, or duty crimes that are verifiable, collect objective evidence, and ensure authenticity And accuracy.

Article 33 the discipline inspection and supervision organs shall formulate a work plan, set up a verification team, and carry out the examination and approval procedures by means of preliminary verification to deal with the problem clues. If the person under inspection is the main person in charge of the party committee (party group) at the next level, the discipline inspection and supervision organ shall report to the main person in charge of the party committee at the same level for approval.

Article 34 The verification team may, upon approval, take necessary measures to collect evidence, talk with relevant personnel to understand the situation, request relevant organizations to make explanations, obtain personal reports on relevant matters, consult copied documents, accounts, archives and other materials, and check the situation of assets And related information, conduct identification and inspection. The verification team shall temporarily detain the property handed in by the person under verification and relevant personnel on their own initiative.

If it is necessary to take measures such as technical investigation or restriction of exit, the discipline inspection and supervision organs shall strictly perform the examination and approval procedures and submit them to the relevant organs for implementation.

Article 35 After the completion of the preliminary verification work, the verification team shall write a preliminary verification report, setting out the basic information of the verified person, the main problems reflected, the basis for handling, the results of the preliminary verification, the existing doubts and the handling suggestions, which shall be signed by all the personnel of the verification team for future reference.

The undertaking department shall comprehensively analyze the preliminary verification situation, and put forward disposal suggestions in accordance with the proposed case for review and investigation, settlement, conversation reminder, temporary storage for investigation, or transfer to relevant party organizations for processing.

The preliminary verification report shall be submitted to the main person in charge of the discipline inspection and supervision organ for examination and approval, and shall be reported to the main person in charge of the party committee at the same level when necessary.

Chapter VII Examination and Investigation

Article 36 the Party committee (Party group) shall, in accordance with the administrative authority, strengthen the examination, investigation and disposal of Party members, cadres and supervision objects suspected of serious violations of discipline, job violations and job-related crimes, regularly listen to reports on major cases, strengthen the mechanism construction of anti-corruption coordination institutions, and unswervingly, accurately and orderly punish corruption.

Article 37: After preliminary verification, the discipline inspection and supervision agency shall file a case for review and investigation if party members, cadres, and supervisory objects are suspected of violating discipline, duty violations, or duty crimes, and need to be investigated for disciplinary or legal responsibility.

Anyone who applies for approval to file a case shall have mastered some facts and evidence of violation of discipline or duty law or duty crime, and have the conditions for examination and investigation.

Article 38 if the conditions for filing a case are met, the undertaking department shall draft a report on filing a case for examination, investigation and approval, which shall be examined and approved by the principal responsible person of the discipline inspection and supervision organ and submitted to the principal responsible person of the party committee at the same level for approval, and shall be put on file for examination and investigation.

The decision to file a case for review and investigation shall be announced to the person under review and notified to the main person in charge of the party committee (party group) where the person under review is located.

Article 39: For persons suspected of serious violations of discipline, duty violations, or duty crimes, the main person in charge of the discipline inspection and supervision agency shall preside over a special meeting attended by the relevant person in charge of the discipline inspection and supervision agency to study and approve the review and investigation plan.

The relevant person in charge of the discipline inspection and supervision agency approved the establishment of a review and investigation team, determined the review and investigation conversation plan, the external investigation plan, the approval of important information inquiries, and the seizure of property involved in the case.

The main person in charge of the supervision, inspection, review and investigation department organizes research and puts forward the review and investigation conversation plan, the external investigation plan and the disposal opinions and suggestions, approves the general information inquiry, and checks the investigation and evidence collection.

The leader of the examination and investigation team shall strictly implement the examination and investigation plan and shall not change it without authorization; report the progress of the examination and investigation in writing and ask for instructions in time in case of important matters.

Article 40 The examination and investigation team may, in accordance with the Party Constitution and the Supervision Law, conduct interviews, interrogations, inquiries, liens, inquiries, freezing, search, retrieval, seizure, seizure (temporary detention, sealing), inspection and inspection, Appraisal, request the relevant agencies to take measures such as technical investigation, wanted, and restriction of exit.

The undertaking department shall establish a ledger, record the use of measures, and file regularly with the case supervision and management department.

The case supervision and management department shall check and inspect, regularly summarize the use of important measures and report to the leadership of the Commission for Discipline Inspection and Supervision and the higher-level discipline inspection and supervision agency. If it is found that the measures are used in violation of regulations, disciplines and laws, it shall be dealt with in different situations to prevent unauthorized expansion of the scope and extension of the time limit.

Article 41 Where it is necessary to take lien measures against the person under examination and investigation, it shall be carried out in accordance with the Supervision Law.Notify their units and their families within hours and release them to the public in a timely manner. If it is inappropriate to notify or make public the circumstances that hinder the investigation, such as the possibility of destroying or falsifying evidence, interfering with the testimony of witnesses or colluding with confessions, it shall be reported for approval in accordance with the procedures and recorded. After the circumstances that hinder the investigation disappear, the unit and family members of the detained person shall be notified immediately.

Article 42 Examination and investigation shall be conducted by two or more persons in accordance with the provisions, who shall produce their certificates and issue written notices in accordance with the provisions.

Article 43 after the approval of the investigation plan for filing a case for examination, the relevant person in charge of the discipline inspection and supervision organ or the person in charge of the department shall have a conversation with the person under examination and investigation, announce the decision on filing the case, state the party's policy and discipline, and require the person under examination and investigation to correct his attitude and cooperate with the examination and investigation.

The review and investigation shall fully listen to the statements of the person under review, ensure their diet, rest, provide medical services, and ensure safety. It is strictly forbidden to use means that violate the party constitution, party rules, party discipline and national laws, and it is strictly forbidden to extort confessions, induce confessions, insult, beat and scold, abuse, corporal punishment or corporal punishment in disguised forms.

Article 44 during the period of examination and investigation, the person under examination and investigation shall be matched with comrades, arrange to study the party constitution, party rules, party discipline and relevant laws and regulations, carry out education on ideals, beliefs and purposes, and through in-depth and meticulous ideological and political work, urge them to reflect deeply, understand mistakes, explain problems, and write repentance and reflection materials.

Article 46: Discipline inspection and supervision agencies shall collect and identify evidence in strict accordance with regulations and disciplines, be comprehensive and objective, and form a mutually corroborating, complete and stable chain of evidence.

Investigation and evidence collection shall collect the original, count the numbers one by one, register on the spot, and be signed and sealed by the personnel on the spot. If the original is inconvenient to carry, preserve or obtain the original, the original may be sealed and photographed and recorded or a copy or photocopy of the original may be obtained. The conversation shall be recorded on the spot and signed by the interlocutors after reading it. The evidence obtained must be submitted to the examination and investigation team for unified custody in a timely manner.

Article 47 The examination and approval procedures shall be strictly performed for the seizure, seizure (temporary detention and sealing), freezing and transfer of the property involved in the case.

Article 48 The examination, investigation, conversation, search, seizure, seizure (temporary detention, sealing up) of the property involved in the case and other important evidence collection work for suspected serious violations of discipline or duty violations or duty crimes shall be recorded and recorded throughout the whole process, and shall be properly kept and filed in a timely manner, and the case supervision and management department shall regularly check.

Article 49 For the review and investigation of suspected serious violations of discipline or duty violations, or duty crimes, the supervisory discipline enforcement personnel shall not take the person under review or other important conversations or inquiries away from the regulations without approval and relevant procedures. Article 51 After ascertaining the suspected violation of discipline or duty violation, or duty crime, the examination and investigation team shall write factual materials, meet with the person under examination and investigation, and listen to opinions. The person under examination and investigation shall sign the opinion on the factual materials, and if he signs a different opinion or refuses to sign an opinion, the examination and investigation team shall explain or indicate the situation.

At the end of the review and investigation work, the review and investigation team shall collectively discuss and form a review and investigation report, which lists the basic information of the person under review, the source of the problem clues, the basis of the review and investigation, the review and investigation process, the main violations of discipline or duty violations, and the facts of duty crimes. The attitude and understanding of the investigator, handling suggestions and the legal basis of party discipline shall be signed by the leader of the review and investigation team and relevant personnel.

Chapter VIII Trial

Article 53 the discipline inspection and supervision organs shall examine and check suspected cases of violation of discipline, law or crime in strict accordance with the rules and regulations, and put forward opinions on disciplinary treatment or punishment, so as to ensure that the facts are clear, the evidence is conclusive, the nature is accurate, the handling is appropriate, the procedures are complete and the procedures are compliant.

Disciplinary handling or punishment must adhere to the principle of democratic centralism, collective discussion and decision, no individual or a small number of people are allowed to decide and approve.

Article 54 The principle of separation of examination and investigation from trial shall be adhered to, and examination and investigation personnel shall not participate in the trial. Article 55 The trial shall be conducted in accordance with the following procedures:

Article 58 The property obtained by the person under review in violation of regulations, disciplines and laws shall be confiscated in accordance with regulations and disciplines, ordered to refund compensation, or registered and handed in.

The property derived from the suspected duty crime shall be transferred to the judicial organ along with the case.

If it is determined that it does not belong to violations of regulations, disciplines and laws, it shall be returned in accordance with regulations and disciplines after the case is concluded, and the formalities for receipt shall be gone through.

Article 59 A complaint against the decision of punishment shall be accepted by the Party committee (Party group) or the discipline inspection and supervision organ that approved or decided on the punishment; if it is necessary to reconsider and review, it shall be accepted after approval by the relevant person in charge of the discipline inspection and supervision organ.

The complaint handling department sets up a review team to review the original case file, and can collect evidence when necessary. Article 65 The recusal system shall be strictly enforced. During the work of the members of the review and investigation team, they shall use special mobile phones, computers, electronic equipment and storage media, implement number management, and withdraw for inspection after the review and investigation work.

Encryption facilities shall be used for reporting the case and transmitting the examination and investigation materials, and special personnel shall be assigned to carry the case file materials in a special vehicle and the volume shall not leave the body.

Article 68 after leaving their posts, the relevant secret-related personnel of the discipline inspection and supervision organs shall abide by the regulations on the management of the secret period, strictly perform the obligation of confidentiality, and shall not disclose the relevant secrets.

Article 71: For disciplinary inspection and supervision cadres who exceed their authority to contact the heads of the party committees (party groups) of relevant regions, departments, and units, privately keep clues, run out of air, violate safety and confidentiality regulations, accept requests, intervene in review and investigations, use cases for personal gain, and handle favors. Case, insult, beat, scold, abuse, corporal punishment or disguised corporal punishment of the investigated person under review, collect evidence in violation of violations of discipline and law, embezzlement, embezzlement, acts such as accepting banquets and property shall be dealt with seriously in accordance with regulations and disciplines; those suspected of duty violations or duty crimes shall be investigated for legal responsibility in accordance with the law.

Article 72 if the discipline inspection and supervision organs are dereliction of duty in maintaining the discipline of supervision and discipline enforcement, they shall be seriously held accountable.

Chapter X Supplementary Provisions

Article 76 The Central Commission for Discipline Inspection shall be responsible for the interpretation of these Rules.
